EU AI Act Penalties: What Happens If You Don't Comply?

The EU AI Act carries some of the heaviest penalties in tech regulation. Understanding the fine structure helps prioritize compliance efforts.

The Fine Tiers

Prohibited Practices: €35M or 7% of global turnover The harshest fines apply to violations of Article 5 — using banned AI practices like social scoring, subliminal manipulation, or emotion recognition in the workplace.

High-Risk Non-Compliance: €15M or 3% of global turnover Failing to meet requirements for high-risk AI systems (Articles 8-15) — missing documentation, no risk management system, inadequate human oversight.

Incorrect Information: €7.5M or 1% of global turnover Providing incorrect, incomplete, or misleading information to regulators or notified bodies.

SME Consideration For SMEs and startups, the regulation says fines should be proportionate. The lower of the two amounts (fixed or percentage) applies.

Why Enforcement Will Be Real

The Extraterritorial Reach

The fines apply to any company whose AI systems affect EU users, regardless of where the company is based. A US company with no EU office can still be fined if their AI touches EU users.

  1. Classify your AI systems now — know which risk tier you fall into
  2. Prioritize prohibited practices — these are already enforceable
  3. Build compliance documentation for high-risk systems before August 2026
  4. Budget for compliance — it's cheaper than the fines
